1 An Act relating to the licensure of electrical and mechanical
2 gambling amusement devices and the licensure of manufacturers
3 and distributors thereof and making penalties applicable.

1 1 Section 1. Section 99B.10, Code 2003, is amended by adding
1 2 the following new subsection:
1 3 NEW SUBSECTION. 4. Each electrical and mechanical
1 4 amusement device in operation or distributed in this state is
1 5 licensed by the department as provided by this subsection.
1 6 Each person engaging in business as a distributor of
1 7 electrical and mechanical amusement devices in this state
1 8 shall obtain a license tag for each electrical and mechanical
1 9 amusement device distributed. Upon receipt of an application
1 10 and a fee of twenty=five dollars for each device, the
1 11 department shall issue a biennial license tag which tag shall
1 12 be displayed as required by rules adopted by the department.
1 13 The application shall be submitted on forms designated by the
1 14 department and contain the information required by rule of the
1 15 department. A license may be renewed biennially upon payment
1 16 of the biennial license fee and compliance with this chapter
1 17 and the rules adopted pursuant to this chapter.
1 18 Sec. 2. NEW SECTION. 99B.10A MANUFACTURERS AND
1 19 DISTRIBUTORS OF ELECTRICAL AND MECHANICAL AMUSEMENT DEVICES ==
1 20 LICENSE.
1 21 A person shall not engage in business as a manufacturer or
1 22 a distributor of electrical and mechanical amusement devices
1 23 in this state without first obtaining a license from the
1 24 department. Upon receipt of an application and a fee of two
1 25 thousand dollars for a manufacturer's license or a fee of one
1 26 thousand dollars for a distributor's license, the department
1 27 shall issue an annual license. The application shall be
1 28 submitted on forms designated by the department and contain
1 29 the information required by rule of the department. A license
1 30 may be renewed annually upon payment of the annual license fee
1 31 and compliance with this chapter and the rules adopted
1 32 pursuant to this chapter.
1 33 EXPLANATION
1 34 This bill amends Code section 99B.10, governing electrical
1 35 and mechanical amusement devices, to provide that the devices
2 1 are required to be licensed. The Code section is amended to
2 2 provide for a $25 biennial license tag for each device, which
2 3 tag shall be displayed on each device in use. New Code
2 4 section 99B.10A is created to provide that a person shall not
2 5 engage in business as a distributor or manufacturer of
2 6 electrical and mechanical amusement devices without a license.
2 7 The new Code section provides for a $2,000 manufacturer's
2 8 license and a $1,000 distributor's license, which shall be
2 9 issued on an annual basis. Pursuant to Code sections 99B.15
2 10 and 99B.16, a person who fails to comply with the limitations
2 11 imposed by this bill or willfully fails to submit records as
2 12 required commits a serious misdemeanor.
