1 1 Section 1. Section 368.11, subsection 1, Code 2011, is
1 2 amended to read as follows:
1 3 1. A petition for incorporation, discontinuance, or
1 4 boundary adjustment may be filed with the board by a city
1 5 council, a county board of supervisors, a regional planning
1 6 authority, or five percent of the registered voters of a
1 7 city or territory involved in the proposal. A petition for
1 8 discontinuance or boundary adjustment may be filed with the
1 9 board by a city council, a county board of supervisors, a
1 10 regional planning authority, or five percent of the registered
1 11 voters of the city involved in the proposal. Notice of the
1 12 filing, including a copy of the petition, must be served upon
1 13 the council of each city for which a discontinuance or boundary
1 14 adjustment is proposed, the board of supervisors for each
1 15 county which contains a portion of a city to be discontinued or
1 16 territory to be incorporated, annexed or severed, the council
1 17 of a city if an incorporation includes territory within the
1 18 city's urbanized area, and any regional planning authority for
1 19 the area involved.
1 20 EXPLANATION
1 21 This bill modifies the filing requirements for petitions
1 22 to the city development board involving involuntary city
1 23 development action by specifying that a petition for
1 24 incorporation must be filed with the city development board
1 25 by 5 percent of registered voters of a territory involved in
1 26 the proposal, and a petition for discontinuance or boundary
1 27 adjustment must be filed with the city development board by
1 28 5 percent of registered voters of the city involved in the
1 29 proposal.
1 30 Current law which allows petitions for incorporation,
1 31 discontinuance, or boundary adjustments to also be filed by
1 32 a city council, a county board of supervisors, or a regional
1 33 planning authority involved in the proposal is maintained.
