SENATE FILE BY COMMITTEE ON JUDICIARY (SUCCESSOR TO SSB 3143) (As Amended and Passed by the Senate February 25, 2010) A BILL FOR 1 An Act relating to grandparents' rights to receive notice 2 regarding child in need of assistance and related reviews 3 and proceedings. 4 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: SF 2302 (1) 83 jp/nh/jh PAG LIN 1 1 Section 1. Section 232.88, Code 2009, is amended to read as 1 2 follows: 1 3 232.88 Summons, notice, subpoenas, and service. 1 4 After a petition has been filed, the court shall issue and 1 5 serve summons, subpoenas, and other process in the same manner 1 6 as for adjudicatory hearings in cases of juvenile delinquency 1 7 as provided in section 232.37. Reasonable notice shall be 1 8 provided to the persons required to be provided notice under 1 9 section 232.37 and to the child's known grandparents, except 1 10 that notice shall be waived regarding a person who was notified 1 11 of the adjudicatory hearing and who failed to appear. The 1 12 notice to the child's known grandparents shall inform the 1 13 grandparents of the opportunity to be heard in hearings and 1 14 reviews pursuant to section 232.91, that the grandparents may 1 15 petition the court for appointment as the child's guardian 1 16 or custodian or for visitation with the child, and that the 1 17 grandparents do not have a right to counsel in connection 1 18 with the hearings and reviews unless appointed as guardian or 1 19 custodian as provided for in section 232.89. In addition, 1 20 reasonable notice for any hearing under this division shall 1 21 be provided to the agency, facility, institution, or person, 1 22 including a foster parent, relative, or other individual 1 23 providing preadoptive care, with whom a child has been placed.
