Section 321.1, subsection 86, Code Supplement 1 2 2005, is amended by striking the subsection. 1 3 Sec. 2. Section 321.34, subsection 3, Code Supplement 1 4 2005, is amended to read as follows: 1 5 3. RADIO OPERATORS PLATES. The owner of an automobile, 1 6 motorcycle, trailer, or motor truck a motor vehicle, trailer, 1 7 or travel trailer registered in this state who holds an 1 8 amateur radio license issued by the federal communications 1 9 commission may, upon written application to the county 1 10 treasurer accompanied by a fee of five dollars, order special 1 11 registration plates bearing the call letters authorized the 1 12 radio station covered by the person's amateur radio license. 1 13 When received by the county treasurer, such special 1 14 registration plates shall be issued to the applicant in 1 15 exchange for the registration plates previously issued to the 1 16 person. Not more than one set of special registration plates 1 17 may be issued to an applicant. Said The fee shall be in 1 18 addition to and not in lieu of the fee for regular 1 19 registration plates. Special registration plates must shall 1 20 be surrendered upon expiration of the owner's amateur radio 1 21 license and the owner shall thereupon then be entitled to the 1 22 owner's regular registration plates. The county treasurer 1 23 shall validate special plates in the same manner as regular 1 24 registration plates, upon payment of five dollars in addition 1 25 to the regular annual registration fee. 1 26 Sec. 3. Section 321.34, subsection 5, paragraph a, Code 1 27 Supplement 2005, is amended to read as follows: 1 28 a. Upon application and the payment of a fee of twenty= 1 29 five dollars, the director may issue to the owner of a motor 1 30 vehicle, registered in this state or a trailer, or travel 1 31 trailer registered in this state, personalized registration 1 32 plates marked with up to seven initials, letters, or 1 33 combination of numerals and letters requested by the owner. 1 34 However, personalized registration plates for motorcycles and 1 35 motorized bicycles shall be marked with no more than six 2 1 initials, letters, or combinations of numerals and letters. 2 2 Upon receipt of the personalized registration plates, the 2 3 applicant shall surrender the regular registration plates to 2 4 the county treasurer. The fee for issuance of the 2 5 personalized registration plates shall be in addition to the 2 6 regular annual registration fee. 2 7 Sec. 4. Section 321.34, subsection 8, unnumbered paragraph 2 8 1, Code Supplement 2005, is amended to read as follows: 2 9 The owner of a motor vehicle subject to registration under 2 10 section 321.109, subsection 1, motorcycle, trailer, or motor 2 11 truck or travel trailer registered in this state who has been 2 12 awarded the congressional medal of honor may, upon written 2 13 application to the department, order special registration 2 14 plates which shall be red, white, and blue in color and shall 2 15 bear an emblem of the congressional medal of honor and an 2 16 identifying number. Each applicant applying for special 2 17 registration plates under this subsection may purchase only 2 18 one set of registration plates under this subsection. The 2 19 application is subject to approval by the department and the 2 20 special registration plates shall be issued to the applicant 2 21 in exchange for the registration plates previously issued to 2 22 the person. The special plates are subject to an annual 2 23 registration fee of fifteen dollars. The department shall 2 24 validate the special plates in the same manner as regular 2 25 registration plates are validated under this section. The 2 26 department shall not issue special registration plates until 2 27 service organizations in the state have furnished the 2 28 department either the special dies or the cost of the special 2 29 dies necessary for the manufacture of the special registration 2 30 plate. 2 31 Sec. 5. Section 321.34, subsection 8A, Code Supplement 2 32 2005, is amended to read as follows: 2 33 8A. EX=PRISONER OF WAR SPECIAL PLATES. The owner of a 2 34 motor vehicle subject to registration under section 321.109, 2 35 subsection 1, motorcycle, trailer, or motor truck or travel 3 1 trailer registered in this state who was a prisoner of war 3 2 during a time of military conflict may, upon written 3 3 application to the department, order only one set of special 3 4 registration plates with an ex=prisoner of war processed 3 5 emblem. The emblem shall be designed by the department in 3 6 cooperation with the adjutant general and shall signify that 3 7 the owner was a prisoner of war as described in this 3 8 subsection. The application is subject to approval by the 3 9 department, in consultation with the adjutant general. The 3 10 special plates shall be issued at no charge and are subject to 3 11 an annual registration fee of fifteen dollars. The county 3 12 treasurer shall validate the special plates in the same manner 3 13 as regular registration plates are validated under this 3 14 section. 3 15 The surviving spouse of a person who was issued special 3 16 plates under this subsection may continue to use or apply for 3 17 and use the special plates subject to registration of the 3 18 special plates in the surviving spouse's name and upon payment 3 19 of the fifteen dollar annual registration fee. If the 3 20 surviving spouse remarries, the surviving spouse shall return 3 21 the special plates to the department and the department shall 3 22 issue regular registration plates to the surviving spouse. 3 23 Sec. 6. Section 321.34, subsection 10, paragraphs a and d, 3 24 Code Supplement 2005, are amended to read as follows: 3 25 a. An owner referred to in subsection 12 of a motor 3 26 vehicle, trailer, or travel trailer registered in this state 3 27 who is a current or retired member of a paid or volunteer fire 3 28 department may, upon written application to the department, 3 29 order special registration plates, designed by the department 3 30 in cooperation with representatives designated by the Iowa 3 31 fire fighters' associations, which signify that the applicant 3 32 is a current or retired member of a paid or volunteer fire 3 33 department. 3 34 d. For purposes of this subsection, a person is considered 3 35 to be retired if the person is recognized by the chief of the 4 1 fire department where the individual served, and on record, as 4 2 officially retired from the fire department. Special 4 3 registration plates with a fire fighter emblem shall be 4 4 surrendered, as provided in subsection 12, in exchange for 4 5 regular registration plates upon termination of the motor 4 6 vehicle owner's membership in the paid or volunteer fire 4 7 department, unless the person is a retired member in good 4 8 standing. 4 9 Sec. 7. Section 321.34, subsection 10A, Code Supplement 4 10 2005, is amended to read as follows: 4 11 10A. EMERGENCY MEDICAL SERVICES PLATES. The owner of a 4 12 motor vehicle subject to registration pursuant to section 4 13 321.109, subsection 1, motor truck, motor home, multipurpose 4 14 vehicle, motorcycle, trailer, or travel trailer registered in 4 15 this state who is a current member of a paid or volunteer 4 16 emergency medical services agency may, upon written 4 17 application to the department, order special registration 4 18 plates, designed by the department in cooperation with 4 19 representatives designated by the Iowa emergency medical 4 20 services association, which plates signify that the applicant 4 21 is a current member of a paid or volunteer emergency medical 4 22 services agency. The application shall be approved by the 4 23 department, in consultation with representatives designated by 4 24 the Iowa emergency medical services association, and the 4 25 special registration plates shall be issued to the applicant 4 26 in exchange for the registration plates previously issued to 4 27 the person. The fee for the special plates shall be is 4 28 twenty=five dollars which shall be paid in addition to the 4 29 regular annual registration fee. The department shall 4 30 validate the special plates in the same manner as regular 4 31 registration plates are validated under this section at the 4 32 regular annual registration fee. 4 33 Sec. 8. Section 321.34, subsection 11, paragraph a, Code 4 34 Supplement 2005, is amended to read as follows: 4 35 a. Upon application and payment of the proper fees, the 5 1 director may issue natural resources plates to the owner of a 5 2 motor vehicle subject to registration under section 321.109, 5 3 subsection 1, motor truck, motor home, multipurpose vehicle, 5 4 motorcycle, trailer, or travel trailer registered in this 5 5 state. 5 6 Sec. 9. Section 321.34, subsection 11A, paragraph a, Code 5 7 Supplement 2005, is amended to read as follows: 5 8 a. Upon application and payment of the proper fees, the 5 9 director may issue "love our kids" plates to the owner of a 5 10 motor vehicle subject to registration under section 321.109, 5 11 subsection 1, motor truck, motor home, multipurpose vehicle, 5 12 motorcycle, trailer, or travel trailer registered in this 5 13 state. 5 14 Sec. 10. Section 321.34, subsection 11B, paragraph a, Code 5 15 Supplement 2005, is amended to read as follows: 5 16 a. Upon application and payment of the proper fees, the 5 17 director may issue "motorcycle rider education" plates to the 5 18 owner of a motor vehicle subject to registration under section 5 19 321.109, subsection 1, motor truck, motor home, multipurpose 5 20 vehicle, motorcycle, trailer, or travel trailer registered in 5 21 this state. 5 22 Sec. 11. Section 321.34, subsection 12, paragraph a, Code 5 23 Supplement 2005, is amended to read as follows: 5 24 a. The owner of a motor vehicle subject to registration 5 25 pursuant to section 321.109, subsection 1, motor truck, motor 5 26 home, multipurpose vehicle, motorcycle, trailer, or travel 5 27 trailer registered in this state may, upon written application 5 28 to the department, order special registration plates with a 5 29 distinguishing processed emblem as authorized by this section 5 30 or as approved by the department. The fee for the issuance of 5 31 special registration plates is twenty=five dollars for each 5 32 vehicle, unless otherwise provided by this section, which fee 5 33 is in addition to the regular annual registration fee. The 5 34 county treasurer shall validate special registration plates 5 35 with a distinguishing processed emblem in the same manner as 6 1 regular registration plates, upon payment of five dollars in 6 2 addition to the regular annual registration fee. 6 3 Sec. 12. Section 321.34, subsection 12A, unnumbered 6 4 paragraph 1, Code Supplement 2005, is amended to read as 6 5 follows: 6 6 An owner of a vehicle referred to in subsection 12 motor 6 7 vehicle, trailer, or travel trailer registered in this state 6 8 who applies for any type of special registration plates 6 9 associated with service in the United States armed forces 6 10 shall be issued one set of the special registration plates at 6 11 no charge, but shall be subject to the annual registration fee 6 12 of fifteen dollars, if all of the following conditions are 6 13 met: 6 14 Sec. 13. Section 321.34, subsections 14, 15, 16, 17, 18, 6 15 19, and 20, Code Supplement 2005, are amended to read as 6 16 follows: 6 17 14. PERSONS WITH DISABILITIES SPECIAL PLATES. An owner 6 18 referred to in subsection 12 or an owner of a trailer used to 6 19 transport a wheelchair of a trailer, as described in section 6 20 321L.2, subsection 1, paragraph "a", subparagraph (1), or 6 21 motor vehicle registered in this state who is a person with a 6 22 disability, or who is the parent or guardian of a child who 6 23 resides with the parent or guardian owner and who is a person 6 24 with a disability, as defined in section 321L.1, may, upon 6 25 written application to the department, order special 6 26 registration plates with a persons with disabilities processed 6 27 emblem designed by the department bearing the international 6 28 symbol of accessibility. The special registration plates with 6 29 a persons with disabilities processed emblem shall only be 6 30 issued if the application is accompanied with a statement from 6 31 a physician licensed under chapter 148, 149, 150, or 150A, a 6 32 physician assistant licensed under chapter 148C, an advanced 6 33 registered nurse practitioner licensed under chapter 152, or a 6 34 chiropractor licensed under chapter 151, written on the 6 35 physician's, physician assistant's, nurse practitioner's, or 7 1 chiropractor's stationery, stating the nature of the 7 2 applicant's or the applicant's child's disability and such 7 3 additional information as required by rules adopted by the 7 4 department, including proof of residency of a child who is a 7 5 person with a disability. If the application is approved by 7 6 the department, the special registration plates with a persons 7 7 with disabilities processed emblem shall be issued to the 7 8 applicant. There shall be no fee in addition to the regular 7 9 annual registration fee for the special registration plates 7 10 with a persons with disabilities processed emblem. The 7 11 authorization for special registration plates with a persons 7 12 with disabilities processed emblem shall not be renewed 7 13 without the applicant furnishing evidence to the department 7 14 that the owner of the vehicle or the owner's child is still a 7 15 person with a disability as defined in section 321L.1. An 7 16 owner who has a child who is a person with a disability shall 7 17 provide satisfactory evidence to the department that the child 7 18 with a disability continues to reside with the owner. The 7 19 registration plates with a persons with disabilities processed 7 20 emblem shall be surrendered in exchange for regular 7 21 registration plates as provided in subsection 12 when the 7 22 owner of the vehicle or the owner's child no longer qualifies 7 23 as a person with a disability as defined in section 321L.1 or 7 24 when the owner's child who is a person with a disability no 7 25 longer resides with the owner. 7 26 15. LEGION OF MERIT SPECIAL PLATES. The owner of a motor 7 27 vehicle subject to registration under section 321.109, 7 28 subsection 1, motorcycle, trailer, or motor truck, or travel 7 29 trailer registered in this state who has been awarded the 7 30 legion of merit may, upon written application to the 7 31 department and presentation of satisfactory proof of the award 7 32 of the legion of merit as established by the Congress of the 7 33 United States, order special registration plates with a legion 7 34 of merit processed emblem. The emblem shall be designed by 7 35 the department in cooperation with the adjutant general and 8 1 shall signify that the owner was awarded the legion of merit. 8 2 The application is subject to approval by the department, in 8 3 consultation with the adjutant general. The special plates 8 4 shall be issued at no charge and are subject to an annual 8 5 registration fee of fifteen dollars. The county treasurer 8 6 shall validate the special plates in the same manner as 8 7 regular registration plates are validated under this section. 8 8 The surviving spouse of a person who was issued special 8 9 plates under this subsection may continue to use or apply for 8 10 and use the special plates subject to registration of the 8 11 special plates in the surviving spouse's name and upon payment 8 12 of the fifteen dollar annual registration fee. If the 8 13 surviving spouse remarries, the surviving spouse shall return 8 14 the special plates to the department and the department shall 8 15 issue regular registration plates to the surviving spouse. 8 16 16. NATIONAL GUARD SPECIAL PLATES. An owner referred to 8 17 in subsection 12 of a motor vehicle, trailer, or travel 8 18 trailer registered in this state who is a member of the 8 19 national guard, as defined in chapter 29A, may, upon written 8 20 application to the department, order special registration 8 21 plates with a national guard processed emblem with the emblem 8 22 designed by the department in cooperation with the adjutant 8 23 general which emblem signifies that the applicant is a member 8 24 of the national guard. The application shall be approved by 8 25 the department in consultation with the adjutant general. 8 26 Special registration plates with a national guard processed 8 27 emblem shall be surrendered, as provided in subsection 12, in 8 28 exchange for regular registration plates upon termination of 8 29 the owner's membership in the active national guard. 8 30 17. PEARL HARBOR SPECIAL PLATES. An owner referred to in 8 31 subsection 12 of a motor vehicle, trailer, or travel trailer 8 32 registered in this state who was at Pearl Harbor, Hawaii, as a 8 33 member of the armed services of the United States on December 8 34 7, 1941, may, upon written application to the department, 8 35 order special registration plates with a Pearl Harbor 9 1 processed emblem. The emblem shall be designed by the 9 2 department in consultation with service organizations. The 9 3 application is subject to approval by the department. 9 4 18. PURPLE HEART SPECIAL PLATES. An owner referred to in 9 5 subsection 12 of a motor vehicle, trailer, or travel trailer 9 6 registered in this state who was awarded a purple heart medal 9 7 by the United States government for wounds received in 9 8 military or naval combat against an armed enemy of the United 9 9 States may, upon written application to the department and 9 10 presentation of satisfactory proof of the award of the purple 9 11 heart medal, order special registration plates with a purple 9 12 heart processed emblem. The design of the emblem shall 9 13 include a representation of a purple heart medal and ribbon. 9 14 The application is subject to approval by the department in 9 15 consultation with the adjutant general. 9 16 19. UNITED STATES ARMED FORCES RETIRED SPECIAL PLATES. An 9 17 owner referred to in subsection 12 of a motor vehicle, 9 18 trailer, or travel trailer registered in this state who is a 9 19 retired member of the United States armed forces may, upon 9 20 written application to the department and upon presentation of 9 21 satisfactory proof of membership, order special registration 9 22 plates with a United States armed forces retired processed 9 23 emblem. The emblem shall be designed by the department in 9 24 consultation with service organizations. The application is 9 25 subject to approval by the department. For purposes of this 9 26 subsection, a person is considered to be retired if the person 9 27 is recognized by the United States armed forces as retired 9 28 from the United States armed forces. 9 29 20. SILVER OR BRONZE STAR PLATES. An owner referred to in 9 30 subsection 12 of a motor vehicle, trailer, or travel trailer 9 31 registered in this state who was awarded a silver or a bronze 9 32 star by the United States government, may, upon written 9 33 application to the department and presentation of satisfactory 9 34 proof of the award of the silver or bronze star, order special 9 35 registration plates with a silver or bronze star processed 10 1 emblem. The emblem shall be designed by the department in 10 2 consultation with the adjutant general. 10 3 Sec. 14. Section 321.34, subsection 21, paragraph a, Code 10 4 Supplement 2005, is amended to read as follows: 10 5 a. An owner referred to in subsection 12 of a motor 10 6 vehicle, trailer, or travel trailer registered in this state 10 7 may, upon written application to the department, order special 10 8 registration plates with an Iowa heritage emblem. The emblem 10 9 shall contain a picture of the American gothic house and the 10 10 words "Iowa Heritage" and shall be designed by the department 10 11 in consultation with the state historical society of Iowa. 10 12 Sec. 15. Section 321.34, subsection 22, paragraph a, Code 10 13 Supplement 2005, is amended to read as follows: 10 14 a. An owner referred to in subsection 12, of a motor 10 15 vehicle, trailer, or travel trailer registered in this state, 10 16 upon written application to the department, may order special 10 17 registration plates with an education emblem. The education 10 18 emblem shall be designed by the department in cooperation with 10 19 the department of education. 10 20 Sec. 16. Section 321.34, subsection 23, paragraph a, Code 10 21 Supplement 2005, is amended to read as follows: 10 22 a. Upon application and payment of the proper fees, the 10 23 director may issue breast cancer awareness plates to an owner 10 24 of a motor vehicle referred to in subsection 12, trailer, or 10 25 travel trailer registered in this state. 10 26 Sec. 17. Section 321.46, subsection 7, Code Supplement 10 27 2005, is amended to read as follows: 10 28 7. If a motor vehicle is leased and the lessee purchases 10 29 the vehicle upon termination of the lease, the lessor shall, 10 30 upon claim by the lessee with the lessor within fifteen thirty 10 31 days of the purchase, assign the registration fee credit and 10 32 registration plates for the leased motor vehicle to the 10 33 lessee. Credit shall be applied as provided in subsection 3. 10 34 Sec. 18. Section 321.109, subsection 1, Code Supplement 10 35 2005, is amended to read as follows: 11 1 1. a. The annual fee for all motor vehicles including 11 2 vehicles designated by manufacturers as station wagons, and 11 3 1993 and subsequent model years for and multipurpose vehicles, 11 4 except motor trucks, motor homes, ambulances, hearses, 11 5 motorcycles, and motor bicycles, and 1992 and older model 11 6 years for multipurpose vehicles, shall be equal to one percent 11 7 of the value as fixed by the department plus forty cents for 11 8 each one hundred pounds or fraction thereof of weight of 11 9 vehicle, as fixed by the department. The weight of a motor 11 10 vehicle, fixed by the department for registration purposes, 11 11 shall include the weight of a battery, heater, bumpers, spare 11 12 tire, and wheel. Provided, however, that for any new vehicle 11 13 purchased in this state by a nonresident for removal to the 11 14 nonresident's state of residence the purchaser may make 11 15 application to the county treasurer in the county of purchase 11 16 for a transit plate for which a fee of ten dollars shall be 11 17 paid. And provided, however, that for any used vehicle held 11 18 by a registered dealer and not currently registered in this 11 19 state, or for any vehicle held by an individual and currently 11 20 registered in this state, when purchased in this state by a 11 21 nonresident for removal to the nonresident's state of 11 22 residence, the purchaser may make application to the county 11 23 treasurer in the county of purchase for a transit plate for 11 24 which a fee of three dollars shall be paid. The county 11 25 treasurer shall issue a nontransferable certificate of 11 26 registration for which no refund shall be allowed; and the 11 27 transit plates shall be void thirty days after issuance. Such 11 28 purchaser may apply for a certificate of title by surrendering 11 29 the manufacturer's or importer's certificate or certificate of 11 30 title, duly assigned as provided in this chapter. In this 11 31 event, the treasurer in the county of purchase shall, when 11 32 satisfied with the genuineness and regularity of the 11 33 application, and upon payment of a fee of ten dollars, issue a 11 34 certificate of title in the name and address of the 11 35 nonresident purchaser delivering the same to the person 12 1 entitled to the title as provided in this chapter. The 12 2 application requirements of section 321.20 apply to a title 12 3 issued as provided in this subsection, except that a natural 12 4 person who applies for a certificate of title shall provide 12 5 either the person's social security number, passport number, 12 6 or driver's license number, whether the license was issued by 12 7 this state, another state, or another country. The provisions 12 8 of this subsection relating to multipurpose vehicles are 12 9 effective January 1, 1993, for all 1993 and subsequent model 12 10 years. The annual registration fee for multipurpose vehicles 12 11 that are 1992 model years and older shall be in accordance 12 12 with section 321.124. 12 13 b. The Except as provided in section 321.113, the annual 12 14 registration fee for a multipurpose vehicle, otherwise subject 12 15 to paragraph "a", with permanently installed equipment 12 16 manufactured for and necessary to assist a person with a 12 17 disability who is either the owner or a member of the owner's 12 18 household in entry and exit of the vehicle or for a 12 19 multipurpose vehicle if the vehicle's owner or a member of the 12 20 vehicle owner's household uses a wheelchair as the only means 12 21 of mobility shall be sixty dollars. For purposes of this 12 22 unnumbered paragraph, "uses a wheelchair" does not include use 12 23 of a wheelchair due to a temporary injury or medical 12 24 condition. 12 25 Sec. 19. Section 321.115, subsection 2, Code 2005, is 12 26 amended to read as follows: 12 27 2. The sale of a motor vehicle twenty years old or older 12 28 which is primarily of value as a collector's item and not as 12 29 transportation is not subject to chapter 322 and any person 12 30 may sell such a vehicle at retail or wholesale without a 12 31 license as required under chapter 322. 12 32 Sec. 20. Section 321.124, subsection 3, unnumbered 12 33 paragraph 1, Code 2005, is amended to read as follows: 12 34 The annual registration fee for motor homes and 1992 and 12 35 older model years for multipurpose vehicles is as follows: 13 1 Sec. 21. Section 321.124, subsection 3, paragraph h, Code 13 2 2005, is amended by striking the paragraph. 13 3 Sec. 22. Section 321.176A, subsection 1, Code Supplement 13 4 2005, is amended to read as follows: 13 5 1. A farmer or a person working for a farmer while 13 6 operating a commercial motor vehicle owned controlled by the 13 7 farmer within one hundred fifty air miles of the farmer's farm 13 8 to transport the farmer's own agricultural products, farm 13 9 machinery, or farm supplies to or from the farm. The 13 10 exemption provided in this subsection shall apply to farmers 13 11 who assist each other through an exchange of services and 13 12 shall include operation of a commercial motor vehicle between 13 13 the farms of the farmers who are exchanging services. 13 14 Sec. 23. Section 321.208, subsection 2, paragraph d, Code 13 15 Supplement 2005, is amended to read as follows: 13 16 d. A felony or aggravated misdemeanor involving the use of 13 17 a commercial motor vehicle other than an offense involving 13 18 manufacturing, distributing, or dispensing a controlled 13 19 substance. 13 20 Sec. 24. Section 321.430, subsection 3, Code 2005, is 13 21 amended to read as follows: 13 22 3. Every trailer, or semitrailer, or travel trailer of a 13 23 gross weight of three thousand pounds or more, and every 13 24 trailer coach or travel trailer of a gross weight of three 13 25 thousand pounds or more intended for use for human habitation, 13 26 when operated on the highways of this state, shall be equipped 13 27 with brakes adequate to control the movement of and to stop 13 28 and hold such vehicle, and so designed as to be applied by the 13 29 driver of the towing motor vehicle from its cab, when operated 13 30 on the highways of this state. Every trailer, semitrailer, or 13 31 travel trailer with a gross weight of three thousand pounds or 13 32 more shall be equipped with a separate, auxiliary means of 13 33 applying the brakes on the trailer, semitrailer, or travel 13 34 trailer from the cab of the towing vehicle, or with self= 13 35 actuating brakes, and shall also be equipped with a weight 14 1 equalizing hitch with a sway control. Every semitrailer, 14 2 travel trailer, or trailer coach of a gross weight of three 14 3 thousand pounds or more shall be equipped with a separate, 14 4 auxiliary means of applying the brakes on the semitrailer, 14 5 travel trailer, or trailer coach from the cab of the towing 14 6 vehicle. Trailers or semitrailers with a truck or truck 14 7 tractor need only comply with the brake requirements. 14 8 Sec. 25. Section 321.457, subsection 1, Code Supplement 14 9 2005, is amended to read as follows: 14 10 1. A combination of four vehicles is not allowed on the 14 11 highways of this state, except for power units saddle mounted 14 12 on other power units which shall be restricted to a maximum 14 13 overall length of seventy=five ninety=seven feet. 14 14 Sec. 26. Section 321A.5, subsection 1, Code 2005, is 14 15 amended to read as follows: 14 16 1. The department shall, immediately or within sixty days 14 17 after the receipt of a report of a motor vehicle accident 14 18 within this state which has resulted in bodily injury or death 14 19 or damage to the property of any one person in excess the 14 20 amount of one thousand dollars or more, suspend the license of 14 21 each operator and all registrations of each owner of a motor 14 22 vehicle in any manner involved in the accident, and if the 14 23 operator is a nonresident the privilege of operating a motor 14 24 vehicle within this state, and if the owner is a nonresident 14 25 the privilege of the use within this state of any motor 14 26 vehicle owned by the owner, unless the operator or owner or 14 27 both shall deposit security in a sum which shall be sufficient 14 28 in the judgment of the department to satisfy any judgment or 14 29 judgments for damages resulting from the accident as may be 14 30 recovered against the operator or owner; provided notice of 14 31 the suspension shall be sent by the department to the operator 14 32 and owner not less than ten days prior to the effective date 14 33 of the suspension and shall state the amount required as 14 34 security. 14 35 Sec. 27. 321L.2, subsection 1, paragraph a, unnumbered 15 1 paragraph 1, Code Supplement 2005, is amended to read as 15 2 follows: 15 3 A resident of the state with a disability desiring a 15 4 persons with disabilities parking permit shall apply to the 15 5 department upon an application form furnished by the 15 6 department providing the applicant's full legal name, address, 15 7 date of birth, and social security number or Iowa driver's 15 8 license number or Iowa nonoperator's identification card 15 9 number, and shall also provide a statement from a physician 15 10 licensed under chapter 148, 149, 150, or 150A, a physician 15 11 assistant licensed under chapter 148C, an advanced registered 15 12 nurse practitioner licensed under chapter 152, or a 15 13 chiropractor licensed under chapter 151, or a physician, 15 14 physician assistant, nurse practitioner, or chiropractor 15 15 licensed to practice in a contiguous state, written on the 15 16 physician's, physician assistant's, nurse practitioner's, or 15 17 chiropractor's stationery, stating the nature of the 15 18 applicant's disability and such additional information as 15 19 required by rules adopted by the department under section 15 20 321L.8. If the person is applying for a temporary persons 15 21 with disabilities parking permit, the physician's, physician 15 22 assistant's, nurse practitioner's, or chiropractor's statement 15 23 shall state the period of time during which the person is 15 24 expected to be disabled and the period of time for which the 15 25 permit should be issued, not to exceed six months. 15 26 Sec. 28. Section 322.27A, unnumbered paragraph 1, Code 15 27 2005, is amended to read as follows: 15 28 A person shall not engage in business as a wholesaler of 15 29 new motor vehicles in this state without a license as provided 15 30 in this chapter. 15 31 Sec. 29. Section 322.29, subsection 2, paragraph c, Code 15 32 2005, is amended by striking the paragraph. 15 33 Sec. 30. Section 326.2, subsection 14, Code 2005, is 15 34 amended to read as follows: 15 35 14. The words "vehicle," "motor vehicle," "motor truck," 16 1 "truck tractor," "road tractor," "trailer," "semitrailer," 16 2 "trailer coach," "combination" or "combination of vehicles," 16 3 "gross weight," "person," "owner," "nonresident," "street" or 16 4 "highway," and "auxiliary axle" shall have the meanings 16 5 ascribed in section 321.1. 16 6 EXPLANATION 16 7 This bill makes numerous changes to Code provisions 16 8 administered by the state department of transportation. 16 9 The bill strikes the definition and use of the term 16 10 "trailer coach" from Code chapters 321 and 326. 16 11 Code section 321.34 is amended to specify that special 16 12 motor vehicle registration plates are available for all motor 16 13 vehicles, trailers, and travel trailers registered in Iowa. 16 14 In addition, the bill clarifies that the surviving spouse of a 16 15 person who was issued ex=prisoner of war or legion of merit 16 16 special plates may continue to use the special plates, subject 16 17 to payment of the same $15 annual registration fee paid by the 16 18 deceased spouse. 16 19 Code section 321.46 is amended to provide that a lessee who 16 20 purchases a vehicle upon termination of the lease has 30 days 16 21 to claim a registration fee credit and assignment of the 16 22 registration plates from the lessor. Currently, the deadline 16 23 for filing such a claim is 15 days from the date of purchase. 16 24 Code sections 321.109 and 321.124 are amended to eliminate 16 25 obsolete provisions relating to annual registration fees for 16 26 model year 1992 and older multipurpose vehicles and to include 16 27 those vehicles and multipurpose vehicles used by certain 16 28 persons with disabilities in the reduced fee schedule 16 29 applicable to other vehicles that are nine or more model years 16 30 old. 16 31 Code section 321.176A is amended to exempt from commercial 16 32 driver licensing requirements farmers and persons working for 16 33 a farmer when operating a commercial motor vehicle controlled 16 34 by the farmer within 150 miles of the farm. Current law 16 35 requires that the commercial motor vehicle be owned by the 17 1 farmer. 17 2 Code section 321.208 is amended to correct language 17 3 relating to commercial driver's license sanctions mandated by 17 4 federal law providing that if a person is found by conviction 17 5 or final administrative action to have committed a felony or 17 6 aggravated misdemeanor involving the use of any motor vehicle 17 7 while the person held a commercial driver's license, other 17 8 than an offense involving manufacturing, distributing, or 17 9 dispensing a controlled substance, the person is disqualified 17 10 from operating a commercial motor vehicle for one year. 17 11 Code section 321.430 is amended to clarify that a trailer, 17 12 semitrailer, or travel trailer with a gross weight of 3,000 17 13 pounds or more must be equipped with either a separate, 17 14 auxiliary means of applying the brakes from the cab of the 17 15 towing vehicle or with self=actuating brakes. 17 16 Code section 321.457 is amended to increase the maximum 17 17 length allowed for a combination of four vehicles consisting 17 18 of power units saddle mounted on other power units to 97 feet, 17 19 from the current maximum of 75 feet. 17 20 Code section 321A.5 is amended to provide that property 17 21 damage of $1,000 or more sustained in a motor vehicle accident 17 22 triggers the security requirements under the motor vehicle 17 23 financial responsibility law. Under current law, the damage 17 24 amount must be in excess of $1,000. This amendment makes the 17 25 damage amount consistent with the amount requiring submission 17 26 of an accident report under Code section 321.266. 17 27 Code section 321L.2 is amended to modify the application 17 28 requirements for a persons with disabilities parking permit by 17 29 requiring the applicant's Iowa driver's license or 17 30 nonoperator's identification card number, or the applicant's 17 31 social security number, which is currently required. 17 32 Code sections 322.27A and 322.29 are amended to eliminate 17 33 licensing requirements for used motor vehicle distributors and 17 34 wholesalers. 17 35 LSB 5386DP 81 18 1 dea:nh/je/5
