1 An Act concerning the length of suspension of alcohol sales
2 licenses and permits after selling alcohol to minors.

1 1 Section 1. Section 123.50, subsection 3, paragraph e, Code
1 2 2005, is amended by adding the following new subparagraph:
1 3 NEW SUBPARAGRAPH. (4) The length of a suspension of a
1 4 license or permit as provided in paragraph "a", "b", or "c"
1 5 shall be reduced by one=half if the licensee or permittee
1 6 submits proof to the administrator or applicable local
1 7 authority that the licensee or permittee has acquired,
1 8 subsequent to the violation, an age and driver's license
1 9 verification device authorized for use by the division. A
1 10 licensee or permittee shall have a suspension reduced pursuant
1 11 to this subparagraph only once.
1 12 EXPLANATION
1 13 This bill provides that the length of suspension of the
1 14 license or permit of a licensee or permittee who is found in
1 15 violation of the provisions prohibiting the selling of alcohol
1 16 to minors can be reduced by one=half if the licensee or
1 17 permittee obtains an age and driver's license verification
1 18 device. The bill provides that the licensee or permittee can
1 19 have the suspension reduced only once for obtaining such a
1 20 device. Current law provides that a suspension for a first
1 21 violation if the permittee fails to pay the civil penalty is
1 22 14 days, while a suspension for a second and third violation
1 23 is 30 days and 60 days, respectively. The bill provides that
1 24 the alcoholic beverages division of the department of commerce
1 25 shall establish which age and driver's license verification
1 26 devices are authorized.
