1 An Act relating to meningococcal disease vaccination information
2 for students who are enrolled in an institution of higher
3 learning that has an on=campus dormitory or residence hall,
4 and providing for related matters.
5 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 1 Section 1. NEW SECTION. 139A.26 MENINGOCOCCAL DISEASE
1 2 VACCINATION INFORMATION FOR POSTSECONDARY STUDENTS.
1 3 1. Each institution of higher education that has an on=
1 4 campus residence hall or dormitory shall provide vaccination
1 5 information on meningococcal disease to each student enrolled
1 6 in the institution. The vaccination information shall be
1 7 contained on student health forms provided to each student by
1 8 the institution, which forms shall include space for the
1 9 student to indicate whether or not the student has received
1 10 the vaccination against meningococcal disease. The
1 11 vaccination information about meningococcal disease shall
1 12 include any recommendations issued by the national centers for
1 13 disease control and prevention regarding the disease.
1 14 Vaccination information obtained under this section that is in
1 15 possession of an institution of higher education pursuant to
1 16 this section shall not be considered a public record. Data
1 17 obtained under this section shall be submitted annually to the
1 18 department in a manner prescribed by the department and such
1 19 that no individual person can be identified.
1 20 2. This section shall not be construed to require any
1 21 institution of higher education to provide the vaccination
1 22 against meningococcal disease to students.
1 23 3. This section shall not apply if the national centers
1 24 for disease control and prevention no longer recommend the
1 25 meningococcal disease vaccine.
1 26 4. This section does not create a private right of action.
1 27 5. The department shall adopt rules for administration of
1 28 this section.
1 29 EXPLANATION
1 30 This bill requires institutions of higher education that
1 31 have on=campus residence halls or dormitories to provide
1 32 students with meningococcal disease vaccination information in
1 33 student health forms. The forms must include space for the
1 34 student to indicate whether or not the student has received
1 35 the vaccination, and shall include recommendations issued by
2 1 the national centers for disease control and prevention
2 2 regarding the disease. Data obtained shall be submitted
2 3 annually to the Iowa department of public health in such a
2 4 manner that no individual person can be identified.
2 5 The bill specifies that institutions of higher education
2 6 are not, under any provision of the bill, required to provide
2 7 vaccinations against meningococcal disease.
2 8 The Iowa department of public health is directed to adopt
2 9 rules to administer the new Code section.
